Business community sees 2011 unfold in dramatic fashion   by Iram

Another boring year in local business 2011 was not.
From the opening scenes of the Crisp & Cole criminal proceedings to a political thriller in the oil fields, drama played out across local industry this year. There were three high-profile workplace deaths, a comeback by a large financial institution, a burst gas pipeline and an unsatisfying end to the drought.

Oil field injections
Local oil fields turned out news by the barrel this year, from the heavily Kern-influenced ouster of the state’s top industry regulators to a sinkhole accident that continues to idle dozens of wells near Taft and focus attention on the sometimes messy practice of steam fracturing.
Both events centered on underground injection work — a touchy subject that in recent years has gained the attention of state and federal regulators. They have expressed concern about injections’ potential to pollute underground water sources when oil producers pump waste materials underground or inject steam at high enough pressure to break up underground formations.
Steam injection work at the prolific Midway-Sunset field near Taft has been cited as a factor in the death of a Chevron construction supervisor who, one morning in late June, stepped into a sinkhole containing steam, oil, scalding hot water and other fluids.
Amid a continuing state investigation into the accident, the Division of Oil, Gas and Geothermal Resources has banned such injections in an increasingly large radius around a nearby oil well that has repeatedly spewed fluids onto the surrounding property. Two companies, including Chevron, have been ordered by DOGGR not to steam in the immediate area, and at least 55 production wells have been idled.
Months before the accident, the agency’s lengthier scrutiny of injection projects prompted local oil producers to complain to the local delegation to Sacramento. In spring, Kern politicians began making the case that delays in getting injection approvals were costing local jobs.
Behind-the-scenes lobbying by Rep. Kevin McCarthy, R-Bakersfield, and Sen. Michael Rubio, D-Shafter, among others, came to a head in late October — just as oil companies warned Wall Street that a project review slowdown at DOGGR was shifting oil investment out of California.
On Nov. 3, Gov. Jerry Brown removed the head of DOGGR, Elena Miller, and her supervisor at the Department of Conservation. No permanent replacements have been appointed, and the sinkhole investigation — as well as the bigger question of how California will regulate oil field injection work going forward — remains open.

Crisp and Cole
In one of the most high-profile mortgage fraud investigations in the history of Kern County, federal agents arrested David Crisp, Carl Cole, six of their former employees, one of Cole’s sons and Crisp’s wife in January.
The arrests of the principals of the now defunct Bakersfield real estate firm of Crisp, Cole & Associates followed four other arrests in the case in 2010 and one in 2009.
The ongoing investigation began after a string of loan defaults connected to the real estate firm or relatives of employees. FBI and IRS agents searched 13 homes and offices related to former Crisp & Cole operations in 2007.
To date, six family members or business associates have accepted plea deals. Crisp, Cole and seven others are awaiting trial.
The next status hearing is scheduled for Feb. 27 in federal court in Fresno.

Refinery reopening
Bakersfield’s biggest refinery reopened in June, putting at least 150 people back to work and re-establishing supply to local agriculture and transportation.
For more than two years the plant sat idle on Rosedale Highway, shutting down as a part of Flying J Inc.’s Chapter 11 bankruptcy. Alon USA Energy paid $40 million in 2010, not including petroleum on site — a bargain the company crowed about in later calls with analysts.
Instead of processing oil, as it used to, the plant now takes in only vacuum gas oil shipped up from Alon’s refinery complex in southeast Los Angeles County. Two mishaps on site caught attention this year — a release of hydrogen sulfide and an explosion at a storage tank — as the company worked to increase production and integrate more seamlessly with its sister operations down south.

Hydrogen plant
Another big deal on the energy scene shifted the focus of one of the county’s most innovative renewable energy projects. In September, BP and Rio Tinto sold their interest in a $2 billion hydrogen energy project designed to bury most of the carbon dioxide from a proposed coal power plant and use it to boost nearby oil production.
The buyer, Massachusetts-based SCS Energy, told of plans to proceed with most of the project but, additionally, to produce hydrogen-rich fertilizer in off-peak times when it makes more financial sense to do that instead of producing power for the grid. SCS hopes to finalize approvals by June 2013 and begin operation in 2017.

Credit union
One of the year’s more encouraging developments was news that Kern Schools Federal Credit Union had achieved a financial goal set by regulators.
After posting big losses and laying off staff in 2010, the county’s largest financial institution was able to post a capital ratio considered healthy in the three months ended June 30.
The credit union spent 2011 trying to drum up new loans, working through complaints about a new online banking interface, and trying to capitalize on rising frustration with large national banks.
Expectations were that Kern Schools had probably finished writing off large amounts of bad debt, and that a smaller branch network would be the main legacy of the downturn.

Drought
Gov. Jerry Brown declared a three-year drought officially over in March, although some growers continued to bemoan a lack of water.
One of the issues for many growers was that even though water was becoming available, it was too late to do anything with it. They needed to know well in advance how much water they would have so they could plant.
Until federal restrictions on pumping delta water are addressed, there will continue to be shortages no matter how much rain falls, some growers insisted. Pumping has been limited for several years to protect threatened fish populations.
Nevertheless, Harry Starkey, general manager of the West Kern Water District, called this rain year “probably one of the biggest turnarounds we’ve seen after a drought.”

Composting facility
A Lamont composting facility caught a lot of attention in 2011 when two immigrant brothers who worked there — one age 16 with identification saying he was 30 — died after apparently inhaling a lethal dose of toxic gases at the bottom of a drainage tunnel.
The plant, Community Recycling & Resource Recovery Inc., part of a family of waste-related companies based in the San Fernando Valley, had a history of violating land use provisions of its county operating permit. That became a focus of an emotional public hearing Nov. 15 at which the county Board of Supervisors voted unanimously to close the facility and fine the company $2.33 million.
Two weeks later the facility was allowed to reopen. A Kern County Superior Court judge stayed the board’s order, mindful that a million gallons or more a day of sewer water flows to the plant for processing. The Lamont Public Utility District warned that this waste stream would spill onto nearby highways and endanger public health if Community Recycling closes for good.
A hearing is set to resume Jan. 24 on whether to keep the stay in place. Cal-OSHA’s investigation of the deaths continues.

Borders
Less than a month after surviving a round of 200 store closings related to Borders Group Inc.’s bankruptcy filing, Bakersfield’s only Borders bookstore in March was placed on a list of 28 additional locations to be shuttered.
The 25,000-square-foot store at 4980 Stockdale Highway originally opened in December 2001 and had 28 employees. It closed in May.
The Ann Arbor, Mich., book retailer filed for Chapter 11 bankruptcy protection in February.
Borders’ widely anticipated filing listed $1.29 billion in debt and $1.27 billion in assets, and came amid complaints from landlords and vendors that they were paid late or not at all.

Victor Victoria’s
The former owner of defunct downtown restaurant Victor Victoria’s was sentenced to 27 months in prison and five years of probation after using her customers’ credit cards to steal.
U.S. District Judge Lawrence O’Neill also ordered former restaurateur Alia Brost to pay $113,600 in restitution to her numerous victims.
Brost, 35, of Bakersfield, appeared in U.S. District Court, Eastern District of California, in Fresno. She had previously pleaded guilty to one count of conspiring to commit wire fraud, two counts of wire fraud and two counts of credit card fraud.
Brost opened Victor Victoria’s in August 2009. The upscale restaurant’s food won rave reviews and was hailed at the time as a sign of downtown Bakersfield’s resurgence, but the eatery closed in July 2010, and toward the end its employees were not getting paychecks.
While the restaurant was open, several customers reported that their credit cards had been charged thousands of dollars after visiting the restaurant, sometimes repeatedly.
The fraudulent charges were reversed and customers were not held liable, but financial institutions and intermediary merchant processing companies were left on the hook for about $125,000 over an eight-month period, according to court documents.

PG&E
A critical natural gas pipeline failed a pressure test in an alfalfa field west of Bakersfield in October, raising questions about overall safety throughout the network.
San Francisco-based Pacific Gas and Electric Co. has been scrutinizing its pipelines since Sept. 9, 2010, when an underground pipeline in San Bruno exploded in a densely populated area. Eight people were killed, 38 homes were destroyed and 70 more were damaged.
PG&E evaluated 150 miles of pipeline in 2011. As part of that process, it conducted 10 hydrostatic pressure tests in Kern County. In such tests, gas flow is stopped and high-pressure water is fed through pipes to determine how much pressure they can handle.
After the pipeline in northwest Bakersfield failed, the line was repaired and passed a subsequent test.
PG&E has prioritized for testing pipes that either are very old or have a nonexistent or incomplete test record. The one that ripped a hole in the alfalfa field, pipeline 300B, was installed in 1950.
PG&E has 391 miles of transmission pipeline in Kern County.

Green Frog
Bakersfield lost the larger of two locations of the family-owned grocery store Green Frog Market.
Green Frog and other independent grocery stores have been slammed by competition from big-box retailers expanding their food offerings.
The closure of the store at Columbus and Oswell streets in November left in its wake allegations of outstanding bills and a host of ex-employees worried about being paid in full.
A second location at Alta Vista Drive and Bernard Street continues to operate.
At least four times over the last 14 months, Green Frog was sued by companies saying they were owed money by the business, according to records on file at Kern County Superior Court.
Meanwhile, employees let go from the closed store were working with representatives of the Golden State United Food and Commercial Workers union, Local 8, to secure vacation pay.

Distribution center
Tejon Ranch Co. lifted Kern’s economic spirits with its announcement that it had sold 46 acres at the junction of Interstate 5 and Highway 99 for development of a Caterpillar parts distribution center. The transaction renewed hopes that the county was well situated to exploit new West Coast logistics patterns.
Caterpillar said it expects to employ 100 to 150 people at the site. The facility is expected to open in late 2012.
